Urge Senators to Support Pre-Trial Determination

Death Penalty Unconstitutional For Persons With Mental Retardation |

| In 2002, the U.S. Supreme Court, in Atkins v.
Virginia, found that the execution of persons with mental
retardation violates the United States Constitution’s Eighth Amendment
ban on cruel and unusual punishment. The Arc of Pennsylvania
supports this decision. However, the Court left it to the states
on how to implement this ban. PA has yet to pass a law to
implement the decision. The Arc of PA is focused on how mental
retardation is defined and when a defendant’s mental retardation is
determined.

ACTION NEEDED |
With the Sen. Pat Vance's introduction of SB 1049*, we
now have adult protective services bills introduced in both the House (HB
361) and the Senate (SB 1049). Now we really need to focus on trying to get
one of
the bills to move. Please take some time in the next week to share with
folks in your organization the request that they contact their state senator
and state representative. The message to both is the same-please do
everything that you can to assure that passage of adult protective services
legislation is a priority this year. For House members, you should ask that
HB 361 be moved out of the Health and Human Services Committee as soon as
possible and given a vote by the full House. For Senators, you can ask that
SB 1049 be voted out of the Senate Aging and Youth Committee soon and that
it be moved through the Senate as quickly as possible.
